1. Acceptance of Terms
By creating an account, accessing, or using the CheckrideLabs platform (the "Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and CheckrideLabs ("Company," "we," "us," or "our"), a business operating from Boston, Massachusetts.
By clicking "I agree," checking the acceptance box, or otherwise using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Nature of Service & AI Limitations
CheckrideLabs uses generative artificial intelligence models to simulate FAA oral examinations. You explicitly acknowledge and agree that:
- AI outputs can hallucinate, misstate Federal Aviation Regulations (FARs), or reference outdated Airman Certification Standards (ACS) content.
- You bear sole responsibility for verifying all content against current FAA publications, Aeronautical Information Manual (AIM), applicable ACS, and guidance from a certificated flight instructor.
- The AI personas ("James," "Sophia") are not real persons, are not Designated Pilot Examiners (DPEs), and hold no regulatory authority of any kind.
- No insight, evaluation, or score generated by the Service should substitute for official pre-flight planning, aeronautical decision-making, or real-world operational authority.
- AI performance may vary across sessions. Identical questions may receive different model-generated responses. This variability is a known limitation of generative AI systems.
3. No FAA Sign-Offs or Certification
The Service does not provide official ground training endorsements, logbook sign-offs, stage check certifications, or graduation certificates under 14 CFR Part 61 or Part 141. Use of this Service does not satisfy any regulatory training requirement. CheckrideLabs is designed exclusively as a self-study aid and examination preparation tool.
4. Pilot in Command — Assumption of Risk
Aviation involves inherent risks. By using CheckrideLabs, you explicitly acknowledge that you are solely responsible for your real-world aeronautical decisions. The Pilot in Command (PIC) is the final authority on the operation of an aircraft (14 CFR § 91.3). CheckrideLabs shall not be held liable for any failed practical examinations, loss of pilot privileges, aircraft damage, bodily injury, or death arising from use of, misuse of, or reliance upon the Service. Your use of this platform is strictly supplementary to — and does not replace — hands-on flight training under a certificated flight instructor.
5. Subscriptions & Hobbs Time
The Service uses a "Hobbs Time" allowance model governing your AI session minutes:
- Base minutes are granted at the start of each billing cycle and reset on your renewal date. Unused base minutes do not roll over.
- Top-Off minutes are purchased separately and do not expire so long as your account remains open and in good standing.
- Your subscription auto-renews at the then-current price at the end of each billing cycle until you cancel. Subscription fees are billed in advance on a recurring basis.
- You may cancel at any time from the Billing page (which opens the Stripe customer portal) or by emailing support@checkridelabs.com. Cancellation takes effect at the end of the current paid period — you retain access through the end of that period.
- All charges are final and non-refundable, except where required by applicable law. Due to the real-time AI voice generation costs involved, partial-month refunds are not issued.
- We reserve the right to modify pricing with at least 30 days' advance notice to your registered email address.
Payments are processed by Stripe, Inc. We do not store your payment card information on our servers.
6. Acceptable Use Policy
You agree not to use the Service to:
- Attempt to access, manipulate, or circumvent minute-tracking systems, billing logic, or session enforcement mechanisms.
- Reverse-engineer, decompile, or extract proprietary AI prompts, scoring rubrics, or system instructions.
- Impersonate any person or entity, or misrepresent your affiliation with a flight school or instructor organization.
- Resell, redistribute, or sublicense access to the Service without express written permission.
- Attempt to scrape session transcripts, voice data, or scoring outputs at scale for competitive or commercial purposes.
- Use the Service for any unlawful purpose or in violation of any applicable FAA or other regulatory requirement.
Violations of this policy may result in immediate suspension or termination of your account without refund.
7. Intellectual Property
All content, design, trademarks, AI personas, scoring methodology, software, and proprietary prompts comprising the CheckrideLabs platform are the exclusive property of CheckrideLabs and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for personal, non-commercial oral examination preparation. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express prior written consent.
Your profile data, session history, and debrief reports remain your property. You grant CheckrideLabs a limited license to store, process, and display this data solely to provide the Service.
8. Account Termination
We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the integrity of the Service or other users. Upon termination, your right to use the Service ceases immediately. Remaining subscription value is forfeited upon termination for cause. You may request account deletion at any time by contacting support@checkridelabs.com.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free, that AI-generated content will be accurate or current, or that any particular examination outcome will result from use of the Service. Your use of the Service is at your sole risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CheckrideLabs, its founders, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation: lost profits, lost data, loss of goodwill, costs of substitute services, failed FAA examinations, flight training delays, increased insurance premiums, or any damages relating to aircraft operations — regardless of whether we were advised of the possibility of such damages.
Our total cumulative liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total fees actually paid by you to CheckrideLabs in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars ($50.00).
11. Indemnification
You agree to defend, indemnify, and hold harmless CheckrideLabs, its founders, officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including FAA regulations; or (d) your reliance on AI-generated content for real-world aeronautical decisions.
12. Dispute Resolution & Arbitration
Informal Resolution: Before initiating any formal dispute, you agree to first contact us at support@checkridelabs.com and provide a written description of the dispute. We will attempt to resolve it informally within 30 days.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, to the extent permitted by law. Arbitration shall occur in Suffolk County, Massachusetts.
Class Action Waiver: YOU AND CHECKRIDELABS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Opt-Out: You may opt out of this arbitration clause by sending written notice to support@checkridelabs.com within 30 days of first creating your account. Opting out does not affect your ability to use the Service.
Severability of this Section: If the Class Action Waiver above is found unenforceable as to any particular claim, that claim (and only that claim) shall be severed and brought in the courts identified in Section 13, while all remaining claims proceed in arbitration. If the entire arbitration agreement is found unenforceable, it shall be severed and the remainder of these Terms shall remain in full force and effect.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Suffolk County, Massachusetts.
14. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via email to your registered address or via an in-app notice at least 14 days before taking effect. Your continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion.
15. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CheckrideLabs regarding the Service and supersede all prior agreements, representations, and understandings. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

1. Introduction & Scope
CheckrideLabs ("Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy describes how we collect, use, share, and retain your information when you use our AI-powered oral exam preparation platform. It applies to all users of our web application and any related services. By using the Service, you consent to the practices described in this Policy. This Policy is incorporated into and subject to our Terms of Service.
2. Information We Collect
We collect only the information necessary to provide and improve the Service:
- Account Data: Email address, full name, and profile photo (optional) — used to provision your account and personalize your PDF debrief scorecards.
- Training Profile Data: Training stage, home airport (ICAO), and target checkride date — used to contextualize session scoring and dashboard readiness indicators.
- Session Data: Examination type, session duration, ACS category scores, and performance history — stored to generate debrief reports and track progress.
- Payment Metadata: Subscription status, plan type, and billing history. We never store or process raw payment card numbers on our servers — all payment data is handled exclusively by Stripe, Inc.
- Usage Data: Page interactions, feature usage patterns, and error logs — collected anonymously to improve product quality.
3. Voice & Audio Data
During live AI examiner sessions, your voice is transmitted in real time via a WebRTC audio stream. You explicitly acknowledge and consent to:
- Your voice audio being transmitted to our third-party voice AI provider (Vapi AI) solely for the purpose of generating AI examiner responses and evaluating session performance.
- Session transcripts being generated and retained to produce your ACS-scored debrief report.
- Voice data being used in aggregate, de-identified form to improve AI model accuracy and session quality.
We do not use your voice recordings for advertising, sell them to data brokers, or share them with third parties beyond those listed as subprocessors in Section 5. We do not use your voice, transcripts, or session content to train general-purpose AI models, and we do not authorize our subprocessors to do so (see Section 5).
4. How We Use Your Data
We use your information exclusively to:
- Provision and maintain your account and session access.
- Generate ACS-mapped performance scores and PDF debrief scorecards.
- Process subscription billing and manage Hobbs Time allocations.
- Send transactional communications (OTP codes, debrief-ready notifications, billing receipts).
- Improve AI model accuracy and product features through aggregated, de-identified analytics.
We do not sell your personal data to data brokers, advertisers, or any third party for commercial purposes.
5. Third-Party Subprocessors
By using the Service, you acknowledge that your data is processed by the following industry-standard subprocessors:
Supabase, Inc.
Secure PostgreSQL database, authentication, and file storage. Stores profile data, session history, and debrief reports. SOC 2 Type II compliant.
Vapi AI
Orchestrates live WebRTC audio sessions with the examiner personas. Vapi routes your audio and transcripts to the underlying model providers it integrates — speech-to-text (Deepgram, with AssemblyAI as fallback), the conversational language model (OpenAI GPT-4.1), and text-to-speech voice synthesis (Cartesia, with Azure and ElevenLabs as fallbacks) — solely to run and evaluate your session.
Stripe, Inc.
Manages all payment processing, subscription billing, and tokenized card security. PCI DSS Level 1 certified. We never receive or store your raw card data.
Make.com & Resend
Backend workflow automation (scoring, billing triggers, minute refresh) and transactional email delivery (OTP codes, debrief notifications, receipts).
Anthropic (Claude)
Processes session transcripts to generate ACS category scores and written debrief analysis. Transcript data is sent to Anthropic's Claude model (via Vapi) for structured scoring.
AI model training. Each subprocessor above processes your data under its commercial API terms solely to deliver the Service. We do not sell your personal data, and we do not use — or authorize these providers to use — your identifiable personal data, voice, or session content to train their general-purpose foundation models. Any use of your data to improve CheckrideLabs is limited to aggregated, de-identified form. Each subprocessor maintains its own privacy and security program; links to their policies are available on request.
6. Data Retention
We retain your data as follows:
- Account & Profile Data: Retained for the life of your account. Deleted within 30 days of an approved account deletion request.
- Session History & Scores: Retained for the life of your account to enable progress tracking. Exported or deleted upon request.
- Voice & Transcript Data: Retained by Vapi AI per their data retention policies. We do not independently retain raw audio recordings beyond the session.
- Billing Records: Retained for 7 years from the date of the transaction, as required by applicable tax and financial record-keeping regulations.
- Anonymized Analytics: Retained indefinitely in aggregate, non-identifiable form.
7. Cookies & Local Storage
We use minimal browser-side storage:
- localStorage (theme preference): Stores your light/dark mode selection. Not a cookie. Contains no personal data and is never transmitted to our servers.
- Supabase Session Token: A secure authentication token stored in localStorage to maintain your logged-in session. This token is used solely to authenticate API requests to Supabase.
We do not use advertising cookies, third-party tracking cookies, or behavioral analytics cookies. CheckrideLabs does not participate in cross-site advertising networks.
8. Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal data:
- Access: Request a copy of the personal data we hold about you.
- Correction: Request correction of inaccurate or incomplete data (also available via the Settings page).
- Erasure: Request permanent deletion of your account and associated personal data.
- Portability: Request an export of your session history and scores in a machine-readable format.
- Restriction: Request that we restrict processing of your data while a correction or objection is pending.
To exercise any of these rights, email support@checkridelabs.com with your request. We will respond within 30 days.
9. California Residents — CCPA Rights
If you are a California resident, the California Consumer Privacy Act (CCPA) grants you additional rights:
- Right to Know: You may request disclosure of the categories and specific pieces of personal information we collect, the purposes for which we use it, and any third parties with whom we share it.
- Right to Delete: You may request deletion of personal information we have collected, subject to certain legal exceptions.
- Right to Opt-Out of Sale: We do not sell personal information. This right is therefore not applicable, but we affirm it here for completeness.
- Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

10. Children's Privacy (COPPA)
CheckrideLabs is intended exclusively for users who are 18 years of age or older. We do not knowingly collect personal information from children under 13. The minimum age requirement for a student pilot certificate under FAA regulations is 14 years for glider/balloon and 16 years for powered aircraft, and the minimum age for a Private Pilot Certificate is 17 years (14 CFR § 61.103). Given the nature of our Service, all registered users must be at least 18. If we discover that a user under 13 has provided personal information, we will delete it promptly. 11. International Data Transfers
CheckrideLabs is operated from the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer. We rely on our subprocessors' standard data processing agreements and, where applicable, Standard Contractual Clauses (SCCs) approved by the European Commission to lawfully transfer data from the European Economic Area.
12. Security
We implement industry-standard technical and organizational measures to protect your personal information, including TLS encryption in transit, row-level security (RLS) on all database tables, and access controls limiting data access to authorized personnel and systems. However, no method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security of your data. In the event of a data breach that compromises your personal information, we will notify you and any applicable regulators without undue delay, as required by law.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated to your registered email address at least 14 days before taking effect. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Service after the effective date constitutes your acceptance of the updated Policy.
